Michelle Flowerday, LL.B.
Founder & CEO
Michelle is a Canadian fertility lawyer and the Owner & Operator of Flowerday Fertility Law, founded in 2010. With her deep knowledge of third-party reproduction law, Michelle is a passionate advocate for those in the infertility, 2SLGBTQIA+, and single status communities who are growing families through surrogacy and ova, sperm, and embryo donation, and the surrogates and donors who make it all possible.
In 2025, Michelle founded Plaid Fertility Law, a web application designed to streamline the fertility agreement process. An approved participant in the Law Society of Ontario’s Access to Innovation (A2I) program, Plaid is exclusive to Michelle’s clients and reflects her commitment to reducing the friction in the legal process while providing efficient, accessible, and tailored services.
Michelle’s clients include Intended Parents from Canada and abroad, as well as Canadian surrogates, donors, fertility clinics, and surrogacy and donor agencies. She is a sought-after speaker at conferences and community events, a frequent podcast guest, and a respected authority on all matters related to surrogacy and third-party reproduction.
Before founding her law firm and technology company, Michelle was a partner at Dickson MacGregor Appell LLP, Canada’s largest all-women law firm, and an associate at McCarthy Tétrault LLP, where she honed her skills in negotiation and family law.
Michelle holds a BA (Hons. Psych.) from McGill University, an LL.B. from Osgoode Hall Law School, and was called to the Ontario Bar in 2002. She is an active member of several professional organizations, ethics committees, and boards that reflect her values of accessibility, inclusivity, quality, and accountability in the delivery of fertility law services.
Michelle resides in midtown Toronto, Ontario, with her spouse and three children. When she’s not attending to clients or developing her fertility law platform, she enjoys spending time in nature, exploring the city, cooking, reading, knitting, moderate biohacking, amateur interior design, and, most of all, cherishing time with her loved ones.
Katie Fitzsimmons, CLC
Law Clerk & Admin Manager
Katie is a Law Clerk at Flowerday Fertility Law, where she plays a key role in enhancing the client experience by supporting the firm’s strategic approach to third-party reproduction. She specializes in guiding Intended Parents, Surrogates, and Donors through the legal complexities of surrogacy and gamete donation agreements, ensuring a smooth and supportive process. Additionally, Katie serves as the Administrative Manager at Plaid Fertility Law, where she assists users of the newly launched, LSO (Law Society of Ontario)-approved fertility law web application. With her in-depth knowledge of surrogacy and gamete donation, technological proficiency, and invaluable personal experience in the realm of third-party reproduction, Katie is truly a fertility law unicorn.
A graduate of Durham College’s Law Clerk Advanced Program in 2014, Katie joined Flowerday Fertility Law in 2020, combining her legal expertise with her passion for helping families grow through surrogacy. Her commitment to the field is deeply personal, rooted in her own experience as a surrogate, having delivered two children for an international couple in 2017 and 2019. This experience has further fueled her dedication to supporting clients as they navigate their own fertility journeys.
Living in Muskoka, Ontario, with her three children, Katie is an active participant in their sports and extracurricular activities. Outside of her professional work, she can often be found juggling school runs, baseball games, cheer practice, or exploring the natural beauty of the area.
Alisha O’Brien, CLC
Law Clerk & Privacy Officer
Alisha is a Law Clerk at Flowerday Fertility Law, specializing in assisting Intended Parents with the legal parentage process and the birth documents required following a surrogacy birth, in addition to providing other administrative support. She also serves as the Privacy Officer at Plaid Fertility Law, where she assists with data security and privacy questions. Alisha’s dedication to family-building is fueled by both her professional experience and her personal journey as a past surrogate. She acted as a surrogate for international Intended Parents in 2021 and Canadian Intended Parents in 2024, maintaining strong, ongoing relationships with both families. These experiences continue to inspire her passion for third-party reproduction.
Alisha holds a Law Clerk Diploma from Fanshawe College in London, Ontario, and brings over 20 years of experience across real estate, corporate, and family law from two private law firms. She has also served as a Court Registrar in the Ontario Superior Court of Justice and as a Clerk in Provincial Offences Court. In 2023, Alisha joined Flowerday Fertility Law, where her diverse legal background enables her to navigate the complexities of surrogacy law with both skill and compassion.
Residing in Norfolk County, Ontario, Alisha enjoys spending time with her spouse and their blended family of six children. She is an active participant in her kids’ sporting events and activities and enjoys hobbies such as reading, watching true crime documentaries, fly fishing, and spending time with their dog, Ellie. Alisha’s personal experiences, combined with her deep understanding of the joys and challenges of family life, further strengthen her commitment to helping families grow through surrogacy and gamete donation.
